These Terms and Conditions set out the basis on which Waste Clearance Bromley provides waste clearance and related services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation requesting the services from Waste Clearance Bromley.

Services means any waste removal, rubbish collection, bulky waste clearance, recycling, loading, transport, or associated services provided by Waste Clearance Bromley.

Waste means any items, materials, goods, or refuse that the Customer asks us to remove and which we agree to collect.

Site means the property, premises or location from which the Waste is to be collected or at which the Services are to be carried out.

2. Scope of Services

Waste Clearance Bromley provides waste collection and clearance services within its designated service area. Services may include domestic waste removal, office and commercial clearance, garden waste removal, bulky item removal, and general rubbish collection, as agreed at the time of booking.

All Services are provided subject to availability, applicable regulations, access constraints at the Site, and the type and volume of Waste to be collected. We reserve the right to decline any job at our discretion, including where Waste is hazardous, prohibited, unsafe to handle, or beyond the agreed scope of work.

3. Booking Process

3.1 Bookings may be made by telephone, email, online enquiry form, or other contact methods offered from time to time. When making a booking you must provide accurate information regarding:

a. The address of the Site and any access restrictions.

b. The type of Waste and approximate volume or number of items.

c. Any heavy, bulky, unusual, or difficult items to be removed.

d. Preferred time and date for the Services.

3.2 Any quotation given at the time of booking will be based on the information provided by the Customer. All quotations are estimates only and are subject to adjustment on Site after inspection of the Waste and assessment of access, parking, and labour requirements.

3.3 Your booking will be confirmed once we have accepted your request and provided you with a scheduled time slot. While we will make reasonable efforts to attend at the agreed time, all times are estimates and may vary due to traffic, weather, or operational issues.

3.4 The Customer, or a responsible adult acting on the Customer’s behalf, must be present at the Site at the start and completion of the Services to confirm the Waste to be removed, agree any changes in price, and make payment where required.

4. Quotations and Pricing

4.1 Prices are generally based on volume, weight, type of Waste, and the time required to complete the work. Additional charges may apply for difficult access, extra labour, parking fees, permits, or specialised disposal requirements.

4.2 Any quotation given before attendance is an estimate only. The final price will be confirmed on Site once our operatives have inspected the Waste. If the actual Waste differs from the description provided at the time of booking, we may adjust the price accordingly.

4.3 If you do not accept the revised price, you may cancel the Service at that point, but a call-out or minimum charge may be payable to cover our time and travel.

4.4 All prices are quoted in pounds sterling and are exclusive of any applicable taxes unless stated otherwise.

5. Payments

5.1 Payment is due immediately upon completion of the Services, unless an alternative arrangement has been agreed in writing in advance.

5.2 We may accept payment by cash, bank transfer, card payment, or other methods as we may specify from time to time. We reserve the right to refuse certain payment methods in particular circumstances.

5.3 For business and account Customers, invoicing arrangements may be agreed in writing. Payment terms for invoices are as stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

5.4 If payment is not received by the due date, we may charge interest on the overdue amount at the statutory rate, together with reasonable administration and recovery costs. We may also suspend further Services until all outstanding sums are paid in full.

6. Cancellations and Rescheduling

6.1 If you wish to cancel or reschedule a booking, you must contact us as soon as possible.

6.2 Cancellations made more than 24 hours before the scheduled arrival time will generally not incur a cancellation fee. However, we reserve the right to recover any specific costs already incurred in relation to your booking.

6.3 Cancellations made less than 24 hours before the scheduled arrival time may incur a cancellation charge, which may be up to a reasonable percentage of the quoted price or our minimum call-out charge.

6.4 If we attend the Site at the agreed time and are unable to carry out the Services due to access issues, parking problems, the absence of an authorised person, safety concerns, or because the Waste differs significantly from that described, we may treat this as a cancellation by the Customer and a call-out or cancellation fee may be payable.

6.5 We may cancel or reschedule a booking due to circumstances beyond our control, including but not limited to severe weather, vehicle breakdown, staff illness, or other operational issues. In such cases we will endeavour to notify you as soon as reasonably practicable and offer a new appointment time. We will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any pre-paid sums for Services not carried out.

7. Customer Obligations

7.1 You must ensure that we have safe, suitable, and lawful access to the Site, including sufficient parking for our vehicle, and that any required permits or permissions are in place.

7.2 You must clearly identify the Waste to be removed and ensure that it does not include any prohibited, hazardous, or illegal materials not previously disclosed to us. If you are unsure whether any item falls into such categories, you should ask us before the work begins.

7.3 You must provide accurate information about the Waste, including any sharp, dangerous, or heavy items that may require special handling.

7.4 You must ensure that children, pets, and any other persons at the Site are kept at a safe distance from our operatives and vehicles while the Services are being carried out.

8. Waste Regulations and Prohibited Items

8.1 Waste Clearance Bromley operates in compliance with applicable UK waste management laws and regulations, including duties relating to the safe handling, transport, and disposal of controlled waste. We will only transfer Waste to appropriately licensed facilities and carriers.

8.2 We do not collect certain categories of Waste, including but not limited to:

a. Hazardous or toxic substances such as chemicals, solvents, asbestos, or clinical waste.

b. Gas cylinders, explosives, or pressurised containers.

c. Certain electrical and electronic equipment that requires specialist treatment, unless agreed in advance.

d. Any items that are illegal to possess, transfer, or dispose of under UK law.

8.3 If prohibited or hazardous Waste is discovered among the items to be collected, we may refuse to remove those items and may adjust the price to reflect any additional time or costs incurred. If the presence of such items makes the job unsafe or unlawful, we may cancel the Service and charge a reasonable fee for our attendance.

8.4 By presenting Waste for collection, you confirm that you are legally entitled to dispose of it and that it does not infringe the rights of any third party. You agree to indemnify us against any claim or loss arising from unlawful or improper disposal resulting from inaccurate information you provide.

9. Title and Responsibility for Waste

9.1 Once our operatives have loaded Waste onto our vehicle and you have paid the agreed charges, legal responsibility for that Waste passes to Waste Clearance Bromley, except where the Waste consists of prohibited or misdescribed items.

9.2 If, after collection, we discover that the Waste includes prohibited, hazardous, or otherwise unacceptable materials that you failed to disclose, you remain responsible for such materials, and we may return them to the Site or charge for their safe treatment and disposal.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing the Services. However, minor scuffs, marks or superficial damage may occur when moving heavy or awkward items. You should move or protect any fragile items, floor coverings, or decorations that may be at risk.

10.2 Our liability for any damage to your property directly caused by our negligence is limited to the reasonable cost of repair or replacement, assessed in light of depreciation and fair wear and tear.

10.3 We will not be liable for:

a. Any indirect, consequential, or economic loss, including loss of profit, business, or opportunity.

b. Any loss arising from delays, cancellations, or failure to perform the Services due to circumstances beyond our reasonable control.

c. Any damage or loss arising from inaccurate information provided by the Customer or from failures to comply with these Terms and Conditions.

10.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Insurance

11.1 Waste Clearance Bromley maintains appropriate public liability and, where applicable, employer liability insurance in respect of its operations.

11.2 You are responsible for ensuring that your own insurance policies provide adequate cover for your property and any specific items that may be at risk during the performance of the Services.

12. Complaints

12.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible, and in any event within 7 days of completion of the work, giving full details of your complaint.

12.2 We aim to investigate and respond to complaints promptly and to seek a fair and reasonable resolution. We may request photographs, access to the Site, or further information to assist in our investigation.

13. Privacy and Data Protection

13.1 We collect and process personal information such as your name, contact details, and address for the purposes of managing bookings, providing the Services, and administering our business.

13.2 We will handle your personal data in accordance with applicable data protection legislation and only retain it for as long as necessary for the purposes for which it was collected or as required by law.

13.3 We will not sell your personal information to third parties. We may share information with service providers or regulatory bodies where necessary to perform the Services or comply with legal obligations.

14. Intellectual Property

14.1 All trademarks, trade names, logos, and other intellectual property used by Waste Clearance Bromley in connection with its business remain the property of their respective owners.

14.2 You may not use our name, branding, or materials for any purpose without our prior written consent.

15. Variations

15.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking or at the time the Services are provided will apply to that booking.

15.2 Any changes or additions to the Services or to these Terms and Conditions must be agreed in writing to be effective.

16. Severability

16.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be deemed removed, but the remaining provisions shall continue to apply in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, whether contractual or non-contractual in nature.
